Terms and Conditions for Online Auctions

Participation Requirements: Valid credit card required for bidding approval, name, valid address, and valid email address. THERE IS A 10% BUYERS PREMIUM ADDED TO THE TOP BID TO ARRIVE AT THE TOTAL AND FINAL CONTRACT PRICE.

Payment Options: Visa, MasterCard, Wire Transfer. For Real Estate your credit card on file with Fowler Auctioneers, Inc. will be charged for down payment the following first business day after auction. --- NO EXCEPTIONS!! If paying by Credit Card there will be a 3% Administrative Fee Assessed. Successful buyer must instruct Fowler Auctioneers, Inc. how they will be paying the down payment. If paying by wire transfer, there will be a $20.00 fee assessed. The successful bidder/buyer must contact Fowler Auctioneers, Inc. for wiring instructions the first business day following auction at 870-356-4848. Invoices for internet purchases will be EMAILED first business day after the auction is complete as a PDF attachment and will include the total price (hammer price + buyers premium).

All property is sold 'AS IS' and ALL SALES ARE FINAL. Property is open to thorough public inspection. ANY ANNOUNCEMENTS MADE DAY OF AUCTION SUPERSEDES ANY MADE PREVIOUS. WHILE ALL REAL ESTATE HEREIN ARE DEEMED TO BE CORRECT, AUCTIONEER, AUCTIONEER'S AGENTS, OR ASSIGNS ASSUME NO RESPONSIBILITY FOR QUANTITY, QUALITY, OR PRESENCE AT OR ON DAY OF AUCTION. DESCRIPTIONS ARE NOT GUARANTEED. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Fowler Auctioneers may attempt to describe the Real Estate in advertising, on the Internet and at the auction but makes no representations. In no event shall Fowler Auctioneers be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect Real Estate as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Fowler Auctioneers shall endeavor to describe in detail Real Estate and any pertinent information about it. Fowler Auctioneers, Inc. is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Fowler Auctioneers or anyone else if the Internet service fails to work correctly before or during the live auction. Fowler Auctioneers, Inc. will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the fowleronlineauctions bidding feature and leave their maximum bid 24 hours before the auction begins. Fowler Auctioneers, Inc. reserves the right to withdraw or re-catalog Real Estate in any auction.
